Article 1 – Scope and Definitions

These General Terms and Conditions apply to all transactions for the purchase of products through the website www.railinox.pt, including registration and ordering.

For the purposes of these General Terms and Conditions, the following definitions apply:

RAILINOX – ACESSÓRIOS, UNIPESSOAL, LDA: a private limited company headquartered at Travessa dos Petigais, 185 – 2400-835 Barosa, Portugal, registered under VAT number 508951348, holder of all copyright and related rights over the website www.railinox.pt, as well as other rights protected under the Industrial Property Code.

Customer: any entity placing an order through the website www.railinox.pt.

These General Terms and Conditions do not affect the Customer’s rights and guarantees under applicable legislation for contracts of this nature.

RAILINOX reserves the right to amend these General Terms of Sale without prior notice, implementing changes on the website while ensuring that such changes do not affect purchases already completed prior to their implementation.
Article 2 – Registration

To place an order, the Customer must be registered on www.railinox.pt by completing the registration form provided.

Once registered, the Customer can access their personal online account using a personal, non-transferable password chosen at registration.

By logging into the website www.railinox.pt, the Customer agrees to these General Terms and Conditions, as well as to all applicable legal and regulatory provisions.
Article 3 – Orders

To place an order, the Customer must log in to their personal account on www.railinox.pt using their email and password.

The Customer must select the product(s) available for online sale and confirm the delivery address, VAT number, and final order validation.

After final validation, the Customer receives an automatic Order Confirmation email.
-
The order is reviewed by RAILINOX’s internal services to verify delivery conditions, a process intended to be as quick as possible, preferably completed the same day.

A follow-up email will indicate product availability and include a Delivery Note with payment details, such as Multibanco reference or IBAN for bank transfer.

Telephone contact may occur if clarification is needed.

Once payment is confirmed, the Customer receives an email with a tracking link to monitor delivery via the website.

Orders can also be tracked through the My Account section of the Customer’s personal account.

Final order validation constitutes the Customer’s full and unconditional acceptance of the transaction, including acceptance of these General Terms of Sale, applicable laws and regulations, the price, and product characteristics, creating mutual obligations for the Customer and RAILINOX.

Products available for ordering are listed on www.railinox.pt.
Article 4 – Prices and Product Features

Product prices are listed in Euros (€) and include VAT at the legal rate, unless otherwise indicated.

Shipping costs are not included and will be added to the total order value after selecting the preferred shipping method.

Prices may be updated at any time without prior notice, but not after the Customer’s order has been accepted by RAILINOX.

Products are accompanied by detailed descriptions on the website, which the Customer is deemed to have read prior to ordering.

Order confirmation formalizes the sales contract and the related delivery service.
-
A summary email of the order is sent to the Customer.
-
Orders are delivered to the address provided by the Customer.
-
Payment may be made via Multibanco, MBWay, or other available methods before delivery.
-
For products sold by weight, the weight is approximate and may vary.
-
Use of www.railinox.pt incurs no additional costs.

The minimum shipping cost for Continental Portugal is €10.
-
Prices are subject to change and may be verified at checkout.

RAILINOX may offer other delivery options with variable costs depending on the selected method.
-
Free shipping may be offered if expressly indicated on the website and will be confirmed at the time of order completion.
Article 5 – Delivery

RAILINOX ships ordered products through a logistics provider to the address indicated by the Customer, which may differ from the billing address.
-
Deliveries follow the provider’s schedule.
-
Products are not delivered to PO boxes.
-
RAILINOX commits to shipping orders within 15 business days.
-
If a product is out of stock, the Customer will be informed and may accept a replacement, without entitlement to compensation.
-
Delivery times are subject to the logistics provider and order destination.
-
The logistics provider requires the recipient’s signature upon delivery. Refusal to sign is recorded and the order is not delivered.

If the order is damaged, the Customer must either refuse delivery or accept it with reservations noted on the delivery document.
-
The Customer must then contact RAILINOX.
-
If delivery fails, a notice will be left, and the Customer must reschedule within 1 business day.
-
Failure to accept delivery due to the Customer’s fault will result in the order being returned to RAILINOX, nullifying the purchase.

RAILINOX is not responsible for delays caused by force majeure, including strikes, pandemics, war, terrorism, natural disasters, extreme weather, or acts of public authority.

Delivery deadlines will be extended accordingly.
-
If force majeure persists for four months, either party may terminate the contract.
Article 6 – Returns Policy

RAILINOX accepts returns when legally required.
-
The Customer has the right to cancel the contract within 30 calendar days from the date of receipt of the goods without incurring costs, without providing a reason, by sending an unequivocal statement to RAILINOX.

The Customer cannot cancel contracts for:
a) Goods made to the consumer’s specifications or clearly personalized.
b) Goods that cannot be returned due to their nature or are likely to deteriorate rapidly.
c) Sealed goods not suitable for return for health or hygiene reasons if opened.
d) Goods inseparably mixed with other items after delivery.
e) Newspapers, periodicals, or magazines, except for subscription contracts. -
Returned products must be in perfect condition, in the original packaging, undamaged, with all accessories or promotional items included, and accompanied by proof of purchase or invoice.

Upon receipt and verification of the product, RAILINOX will process the refund within 30 days.

In case of stock shortages, RAILINOX will refund the amount paid using the original payment method.

Refunds exclude shipping costs, except for defective or wrongly shipped items, in which case RAILINOX covers shipping costs if notified within 1 day of receipt.

Defective products will be replaced or refunded without cost to the Customer.
-
RAILINOX does not accept returns of damaged products, products showing signs of use, or items damaged due to misuse or normal wear.

Complaints or requests for resolution can be sent via email or post to RAILINOX.
Article 7 – Liability

RAILINOX is not responsible for damages caused by third-party interference with the website or damages caused by viruses or other malicious software.

The website www.railinox.pt is intended exclusively for selling medical and orthopedic products and for placing orders; it cannot be used for other purposes.
-
RAILINOX is not liable for misuse of personal login credentials, which are personal and non-transferable.
Article 8 – Duration

These General Terms of Sale apply as long as the commercial relationship between the Customer and RAILINOX continues through the website www.railinox.pt.

RAILINOX may revise or modify these terms at any time.
Article 9 – Proof and Record Keeping

Electronic records maintained by RAILINOX serve as proof of the contract between the parties and the conditions under which it was concluded.

Order and invoice documentation will be stored on reliable and durable media.
Article 10 – Applicable Law and Jurisdiction

These General Terms of Sale are governed by Portuguese law.

In case of disputes regarding validity, interpretation, or application, parties will attempt resolution through dialogue and negotiation.
